Terms of Service

Terms governing use of HiVoltEdge websites, demonstrations, communications, technology, and services.

Effective Date: November 2, 2026

These Terms of Service (“Terms”) govern access to and use of HiVoltEdge websites, demonstrations, communications, digital experiences, and services offered by HiVoltEdge (“HiVoltEdge,” “we,” “us,” or “our”).

By accessing a HiVoltEdge website, submitting information, scheduling a demonstration, communicating with HiVoltEdge, or using services subject to these Terms, you agree to these Terms.

If you enter into a separate proposal, order form, statement of work, subscription agreement, master services agreement, or other written agreement with HiVoltEdge, that agreement will govern the paid services covered by it and will control in the event of a conflict with these website Terms.

1. HiVoltEdge Services

HiVoltEdge provides and supports technology-enabled business growth solutions that may include AI-powered websites, conversational AI, AI voice and reception, lead capture, customer communications, CRM systems, booking and scheduling, follow-up, workflow automation, reviews and reputation systems, marketing and funnels, customer reactivation, Google Business Profile support, search visibility services, integrations, custom digital tools, and related implementation services.

Specific services, deliverables, functionality, pricing, implementation requirements, usage allowances, and support commitments are determined by the applicable proposal or service agreement. Not every feature described on the public website is included in every engagement.

2. Business Use and Authority

HiVoltEdge primarily provides business-to-business services. If you act on behalf of a company or organization, you represent that you have appropriate authority to do so. Information provided to HiVoltEdge must be accurate and not intentionally misleading. HiVoltEdge services may not be used for unlawful, fraudulent, abusive, deceptive, infringing, or unauthorized purposes.

3. Proposals, Orders, Pricing, and Service Agreements

Pricing, setup fees, recurring fees, payment schedules, minimum commitments, cancellation provisions, renewals, implementation scope, usage allowances, third-party charges, and other commercial terms are governed by the applicable written proposal or service agreement.

Information appearing on the public HiVoltEdge website does not create a guaranteed price, implementation timeframe, service level, or contractual commitment unless expressly incorporated into a signed written agreement.

4. Artificial Intelligence and Automated Services

HiVoltEdge services may use artificial intelligence, machine learning, large language models, automated agents, speech recognition, speech-to-text, text-to-speech, transcription, summarization, automated workflows, and decision-support technologies.

Artificial-intelligence systems are probabilistic and may occasionally generate incomplete, inaccurate, outdated, unexpected, or inappropriate output. Clients are responsible for reviewing important information provided to AI systems and determining when human review or approval is appropriate, including information concerning pricing, availability, policies, scheduling, service descriptions, estimates, contractual information, and regulated or professional subjects.

HiVoltEdge does not warrant that AI output will be error-free, uninterrupted, or appropriate for every situation. AI functionality is not a substitute for legal, medical, accounting, financial, tax, insurance, or other licensed professional advice.

5. Client Information and Responsibilities

Clients are responsible for providing accurate, current, and lawful business information, instructions, policies, approved content, service information, pricing information, scheduling rules, data, credentials, access permissions, customer communication requirements, and other materials necessary to configure services. Clients must have sufficient rights to use all content, data, contact lists, customer information, logos, photographs, trademarks, recordings, and other materials they supply or connect to HiVoltEdge services.

Clients are responsible for reviewing systems before public use and promptly notifying HiVoltEdge of material inaccuracies or required changes.

6. Communications, Calling, Email, and Text Messaging

HiVoltEdge services may support telephone calls, SMS, MMS, email, website chat, social messaging, automated follow-up, AI-assisted communications, and similar communication channels. Clients are responsible for using those capabilities in accordance with applicable communications laws, privacy laws, marketing laws, carrier requirements, platform policies, Do Not Call requirements, consent requirements, and industry-specific restrictions.

Where legally required, clients must obtain appropriate consent before sending automated or marketing communications and maintain appropriate records of that consent. Clients must honor valid opt-out or consent-revocation requests. Clients may not knowingly use unlawfully obtained, scraped, rented, purchased, or otherwise unauthorized contact lists through systems configured by HiVoltEdge.

Use of certain U.S. local telephone numbers for application-to-person messaging may require A2P 10DLC registration. Use of U.S. toll-free numbers for text messaging may require Toll-Free Verification. Carrier, platform, provider, and regulatory requirements may change.

Where appropriate consent or another lawful basis exists, HiVoltEdge may send text messages that may include requested information, responses to inquiries, appointment or demonstration confirmations, reminders, service-related communications, follow-up, and—where separately consented to—marketing or promotional messages. Informational or service-related communications are distinct from marketing or promotional communications; opting into one does not automatically opt you into the other, and not every visitor receives marketing texts. Message frequency may vary, and message and data rates may apply. Reply STOP to unsubscribe or opt out of applicable SMS communications. Reply HELP for assistance or contact support@hivoltedge.com. Opting out of SMS does not necessarily opt you out of communications through other channels where legally permitted. Wireless carriers are not liable for delayed or undelivered messages, and delivery of SMS or MMS messages cannot be guaranteed because transmission depends on carriers, networks, devices, and other third-party systems. HiVoltEdge may modify, suspend, or discontinue a messaging program where appropriate, subject to applicable law.

7. Call Recording, Transcription, and Voice AI

Certain services may record, monitor, transcribe, summarize, or analyze telephone or voice communications. Recording, monitoring, biometric, transcription, and consent requirements vary by jurisdiction. Clients are responsible for providing legally required disclosures and obtaining legally required consent from callers, customers, employees, or other participants before using applicable recording, transcription, monitoring, or AI voice functionality.

HiVoltEdge may provide or require configuration intended to support compliance, but HiVoltEdge does not provide legal advice regarding a client's individual recording or consent obligations.

8. Privacy and Data Protection

Each party is responsible for complying with privacy and data-protection obligations applicable to its own activities. Clients are responsible for providing required privacy notices, establishing lawful bases for processing, obtaining legally required permissions or consent, responding to applicable privacy rights, and determining whether particular categories of information may lawfully be collected through a configured system.

Clients should not direct ordinary HiVoltEdge conversational systems to collect highly sensitive or regulated information unless the applicable service has specifically been designed, approved, contracted, and configured for that data. Use of HiVoltEdge public websites is also governed by the HiVoltEdge Privacy Policy.

9. Regulated Industries

Businesses in healthcare, legal services, finance, insurance, veterinary services, and other regulated industries may be subject to additional professional, privacy, security, advertising, recordkeeping, or communications requirements. Availability of a technology feature does not itself make a client's use of that feature legally compliant. Where a particular compliance-enabled configuration, contract, integration, or security requirement applies, it must be specifically identified and implemented.

AI systems configured through HiVoltEdge are not authorized to diagnose medical conditions, prescribe treatment, render legal opinions, provide individualized regulated financial advice, or perform another licensed professional function unless such use is specifically lawful, contracted, and appropriately configured.

10. Reviews and Reputation Services

HiVoltEdge may provide technology or services that help clients request, monitor, organize, manage, or respond to legitimate customer feedback and reviews. Clients may not use HiVoltEdge services to create fake reviews, impersonate customers, purchase deceptive reviews, provide compensation conditioned on positive sentiment, unlawfully suppress negative reviews, manipulate review platforms, or otherwise violate applicable law or platform policies.

Publication, ranking, removal, display, and moderation of reviews remain subject to the applicable third-party platform.

11. Google Business Profile, SEO, AEO, GEO, and Local Visibility

HiVoltEdge may provide services involving Google Business Profile optimization or support, search-engine optimization, Answer Engine Optimization, Generative Engine Optimization, local visibility, website structure, content strategy, technical optimization, structured data, and related digital visibility improvements.

Search engines, map platforms, AI systems, directories, and third-party algorithms are outside HiVoltEdge's control. HiVoltEdge does not guarantee organic search rankings, map rankings, traffic, leads, AI citations, AI recommendations, review volume, customer acquisition, revenue, profitability, or any particular search or business outcome.

These services are intended to improve technical quality, clarity, discoverability, customer experience, and machine understanding using available information and reasonable current practices.

12. Third-Party Platforms and Integrations

HiVoltEdge services may depend upon third-party providers, including cloud providers, website platforms, communications carriers, CRM technology, calendars, social networks, artificial-intelligence providers, payment processors, domain registrars, analytics services, search platforms, and other software providers. Third-party providers may modify their features, pricing, APIs, policies, eligibility, limits, availability, or functionality. HiVoltEdge is not responsible for failures, restrictions, suspensions, outages, policy changes, or other conditions caused solely by independent third-party systems outside HiVoltEdge's reasonable control.

Clients remain responsible for compliance with the terms governing third-party accounts they own or authorize HiVoltEdge to access.

13. No Guaranteed Business Results

HiVoltEdge provides technology, implementation, automation, strategy, and related services designed to improve customer journeys and business processes. Actual outcomes depend on numerous factors beyond HiVoltEdge's control, including market demand, lead quality, traffic, pricing, offers, staff performance, client operations, customer decisions, response behavior, competition, advertising, implementation, third-party platforms, and economic conditions.

No statement appearing on the HiVoltEdge website, in a demonstration, or in general marketing materials constitutes a guarantee of revenue, sales, leads, appointments, rankings, reviews, profitability, return on investment, or another particular business outcome.

14. Intellectual Property

The HiVoltEdge name, branding, website content, designs, methodologies, reusable frameworks, software components, prompts, workflows, templates, documentation, and other proprietary materials are owned by HiVoltEdge or its licensors unless otherwise stated. Clients retain ownership of their pre-existing trademarks, logos, photographs, business content, customer information, and other client-owned materials.

Ownership or licensing of custom client deliverables will be determined by the applicable written service agreement. Nothing in these Terms transfers ownership of HiVoltEdge's pre-existing intellectual property, reusable systems, general know-how, methodologies, or platform technology.

15. Acceptable Use

You may not use HiVoltEdge websites or services to violate law, infringe intellectual-property rights, violate privacy rights, impersonate another person or organization, send unlawful spam, distribute malicious code, interfere with system security, attempt unauthorized access, commit fraud, misrepresent products or services, manipulate reviews, collect sensitive information without authorization, or engage in deceptive, abusive, or harmful conduct.

HiVoltEdge may suspend or restrict access when reasonably necessary to protect systems, users, third parties, or legal compliance.

16. Service Availability and Changes

HiVoltEdge may improve, update, replace, modify, or discontinue website features or general service functionality. HiVoltEdge does not guarantee uninterrupted access to public website features, demonstrations, AI experiences, or third-party integrations. Material changes affecting paid contracted services will be governed by the applicable written agreement.

17. Disclaimers

To the fullest extent permitted by applicable law, the HiVoltEdge website, demonstrations, informational materials, and services not subject to a separate express warranty are provided on an “as is” and “as available” basis. To the extent legally permitted, HiVoltEdge disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

No website content, demonstration, AI response, calculator, estimate, example, projection, or illustration should be interpreted as a promise or guarantee of a particular business outcome.

18. Limitation of Liability

To the fullest extent permitted by law, HiVoltEdge and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the public website or services. This includes, where legally permitted, claims relating to lost profits, lost revenue, lost business opportunities, loss of goodwill, and loss of data.

Liability relating to paid client services, including any agreed aggregate liability limitation, will be governed by the applicable signed service agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded.

19. Indemnification

To the extent permitted by law, users and clients agree to defend, indemnify, and hold harmless HiVoltEdge and its owners, officers, employees, contractors, and affiliates from third-party claims, losses, liabilities, damages, and reasonable costs arising from unlawful use of HiVoltEdge services, content or data supplied without sufficient rights, violation of these Terms, or violation of applicable communications, privacy, advertising, intellectual-property, or consent requirements.

Additional indemnification obligations relating to paid client services may be governed by the applicable service agreement.

20. Governing Law

Unless a separate written agreement states otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

21. Changes to These Terms

HiVoltEdge may update these Terms as services, technology, business practices, or legal requirements change. The current effective date will appear at the top of the Terms. Continued use of the website after revised Terms become effective constitutes acceptance of the revised website Terms to the extent permitted by applicable law. Material changes to an existing paid client agreement will be handled according to that agreement.
